Acceptance of Terms

By accessing or using our website, products, or services (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree, do not use the Service.

Changes to Terms

Eligibility

Accounts and Security

2. Authentication: We may support sign-in via Google/GitHub or email-based sessions when enabled. You are responsible for activities under your account.
3. Security: Keep your credentials confidential and notify us immediately of any unauthorized use or breach.

Plans, Credits, and Billing

1. Subscriptions and Credits: We may offer paid plans and/or credit packages. Credits allow usage of certain features and may expire as described at purchase. Credits have no cash value and are non-transferable.
2. Pricing and Taxes: Prices may change; we will provide notice where required. You are responsible for applicable taxes and fees.
3. Payments: Payments are processed by third-party providers (e.g., Stripe). You authorize us and our processors to charge your payment method for fees incurred.
4. Trials and Promotions: Trials or promotional offers are subject to their terms and may auto-convert to a paid plan unless canceled before the trial ends.
5. Refunds: Except where required by law or stated otherwise, all fees are non-refundable, and we respond to refund-related requests from customers within 3 business days.
6. Chargebacks: Chargebacks may result in immediate suspension or termination.

Acceptable Use

You will not, and will not permit others to:

• Violate laws or third-party rights (including intellectual property, privacy, publicity)
• Upload unlawful, harmful, violent, harassing, or otherwise objectionable content
• Attempt to probe, scan, or test system vulnerabilities, or circumvent security
• Interfere with or disrupt the Service or others' use of it
• Reverse engineer, decompile, or create derivative works of the Service except to the extent permitted by law
• Use automated means to scrape content except as allowed via documented APIs

Your Content; AI Inputs and Outputs

1. Inputs and Outputs: You may provide prompts and assets ("Inputs"). The Service may generate results ("Outputs"). Subject to third-party model/provider terms and any applicable law, you own your Inputs and, to the extent permitted, your rights in Outputs.
2. License to Us: You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, display, and create derivative works from your Content (Inputs/Outputs) solely to provide, maintain, protect, and improve the Service, to comply with law, and to prevent abuse.
3. Model Training: Unless expressly stated otherwise, we do not use your personal content to train our proprietary models. Integrated third-party model providers may have their own policies.
4. Responsibility: You are responsible for your Content and for ensuring you have all necessary rights and permissions. You must not upload Content that is illegal or infringes others’ rights.
5. Publicity/Showcase: We will not disclose your private Content for marketing without your consent, except where you publish it publicly through the Service.

Ownership and Intellectual Property

We and our licensors own all rights, title, and interest in and to the Service, including software, templates, designs, and documentation. These Terms do not transfer any ownership of the Service to you. All rights not expressly granted are reserved.

Third-Party Services

The Service may integrate with or rely on third parties, such as:

• Authentication providers: Google, GitHub (when enabled)
• Payment processors: Stripe
• Analytics: Plausible or similar privacy-friendly analytics
• Model and infrastructure providers

Your use of third-party services is subject to their terms and policies. We are not responsible for third-party services.

Privacy

Termination and Suspension

We may suspend or terminate your access at any time, with or without notice, if you violate these Terms, present a security risk, fail to pay fees, or as required by law. You may stop using the Service at any time. Certain provisions survive termination.

Warranty Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT OUTPUTS WILL BE ACCURATE OR FIT FOR YOUR PURPOSE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS PAID BY YOU TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY OR (B) USD $100.

Indemnification

You will indemnify and hold us and our affiliates, and our respective directors, officers, employees, and agents, harmless from and against any claims, losses, and expenses (including reasonable attorneys’ fees) arising from or related to your Content, your use of the Service, or your violation of these Terms.

Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which we operate, without regard to conflict-of-laws rules. Any dispute will be resolved through binding arbitration or the competent courts of that jurisdiction, unless applicable law requires otherwise.

Export and Sanctions Compliance

You may not use the Service if you are located in, or are a resident or national of, any country subject to embargoes, sanctions, or similar restrictions under applicable laws. You must comply with all export and re-export restrictions and regulations.

Miscellaneous

These Terms constitute the entire agreement between you and us regarding the Service and supersede prior agreements. If any provision is found unenforceable, the remaining provisions remain in full force. You may not assign these Terms without our consent; we may assign them without restriction.
